Overview
When you must take remedial measures under the LkSG and how to record them as Tasks in the Tacto App. Relevant if a violation of human rights or environmental obligations has occurred or is imminent at a direct supplier. The basis is the results of the concrete or ad hoc risk analysis.
Definition
If you determine that a violation of human rights or environmental obligations has already occurred or is imminent at a direct supplier, you must take appropriate remedial measures without delay (Section 7 LkSG).
Remedial measures aim to prevent or end the violation or to minimise its extent.
If the violation cannot be ended in the foreseeable future, you must immediately draw up and implement a concept with a specific timetable.
Developing remedial measures
The LkSG recognises that in most cases you cannot intervene extensively in your direct supplier's business. It therefore imposes no formal requirements on the remediation concept. Which measure is most effective depends on the individual case, in particular on:
the human rights or environmental concerns violated
your company's contribution to causation
your influence on the direct supplier
the severity and reversibility of the violation, the number of people affected and the type of legal position violated
Selecting measures
When selecting measures, rely primarily on the findings from the concrete or ad hoc risk analysis. Address the risks in order of the severity of their impact.
How it works
1. Appoint a person responsible
Determine who in your company manages the measures.
2. Carry out an ad hoc risk analysis
After a known violation, carry out an ad hoc risk analysis.
3. Create measures as Tasks
Open the supplier's profile and go to the Tasks tab.
Click Create Task.
Select a Task template or create your own measure.
Set the Assignee and Due date and save with Create Task.
Note: Tacto provides Task templates for typical measures. You can create your own templates under Settings → Task templates to record measures consistently.
